It premised its motion on two arguments, both of which fell under Rule 12(b)(6) of the Federal Rules of Civil Procedure, which states that defendants can be dismissed from lawsuits if the plaintiffs fail “to state a claim upon which relief can be granted.” In other words, Uber Freight argued that Almo (which filed a third-party complaint against Uber) had not set forth a valid claim against the company.

Uber first argued in its motion that Almo had not alleged enough facts to sustain a valid legal claim. Uber stated that:

Almo has attempted to state a negligence cause of action against Uber Freight based purely on the fact that Uber Freight acted as freight broker in the transaction paired with a presumption—without factual allegations in support—that Uber Freight breached duties to oversee Velox’s operations. Simply put, the facts alleged do not state a claim against Uber Freight, and the negligence claim is subject to dismissal.

However, Judge Molloy quickly dispensed with Uber’s argument and ruled that:

Due to the presence of the contract between Uber and Velox, the Court could infer that Uber has, or should have had, hiring practices to ensure that any federal or state regulations relative to the industry are followed.

This meant that the “claims that Uber did not verify the qualifications or hiring practices of Velox [were] plausible.”

Uber based their second argument on the idea that the Federal Aviation Administration Authorization Act (“the Act”) preempted any claims against the company. But Judge Molloy ruled that binding precedent in the Ninth Circuit did not provide Uber with preemption protection (pursuant to <em>Miller v. C.H. Robinson Worldwide, Inc.</em>). Judge Molloy wrote in his order that:

…Uber seeks to escape Montana’s regulatory authority. Uber argues that any claim related to a broker’s services is expressly preempted under the Act because subsection (c)(1) is unambiguous: state law relating to the services of a broker are preempted. Following Uber’s argument, the Act would preempt any state tort claim against not only the broker, but also the motor carrier and any entity providing services related to the transportation of property as defined by the Act. Thus, if Uber’s argument is accepted, any citizen of Montana would be left without civil recourse in the event of a traffic collision with any interstate motor carrier, which was not the intent of Congress. See <em>Miller</em>, 976 F.3d at 1020.

Furthermore, Uber relies upon irrelevant case law. Uber cites other circuit decisions regarding application of the safety exception in the Act to common law tort claims, but since there is clear direction from the Ninth Circuit any conflicting circuit decisions are irrelevant. Given the Ninth Circuit’s clear treatment of the safety exception to the Act and evidence of Congress’s intent, Almo’s negligence claims are not preempted by the Act because they involve general safety regulations that directly fall under state safety regulatory authority.

In layman’s terms, Judge Molloy ruled that Uber had legal duties to Mr. Poston and every other Montana motorist.

Ultimately, the parties confidentially settled all claims at a settlement conference with Federal Magistrate Judge Kathleen DeSoto in Missoula, Montana.]]></content>

Paoli Law Firm Client Settles with Velox Transport Solutions, LLC, Julio Santos (driver for Velox), Almo Distributing, and Uber Freight

This case arose from a horrific big rig crash that occurred on Highway 2 in Flathead County, Montana in the early morning of January 21, 2022. Julio Santos was driving a semi-tractor trailer owned and operated by Velox Transport Solutions, LLC, which is headquartered in Miami, Florida. Mr. Santos was delivering a load to an address in Columbia Falls, MT. While driving on Highway 2 past Kalispell, he was notified of a change in the delivery address. Mr. Santos entered the new address into his GPS and realized he needed to turn around. Rather than drive to an intersection or another safe spot to do so, he decided to make an illegal U-turn across several lanes of traffic. Mr. Santos failed to observe, let alone yield to, any of the traffic around him and failed to see Michael Poston travelling in the same direction in the lane directly to the left of him. Mr. Santos turned in front of Mr. Poston, causing Mr. Poston to crash into the trailer as it was perpendicular across both lanes of traffic. Mr. Poston’s pickup truck became lodged underneath the semi-truck and had the roof sheared off. Not surprisingly, this caused severe and catastrophic skull fractures and brain trauma. Mr. Poston only survived because he was able to quickly lean over his passenger seat, and a nurse passing in a separate vehicle stopped to maintain Mr. Poston’s airway until emergency responders could arrive.

Not only was Mr. Poston severely injured in the crash, but he was pinned in his pickup truck under the trailer for over an hour while emergency responders attempted to extract him. He was eventually removed and rushed to Logan Health, where he required a bifrontal craniotomy along with several other extensive surgeries throughout his month-long stay there. He required in-patient therapy and rehabilitation for months after his release from the hospital, treatment which is still ongoing.

Mr. Poston filed a lawsuit against Velox Transport Solutions, LLC, the driver, Julio Santos, CES Hospitality, Uber Freight, and Almo Distributing. CES Hospitality contracted with Almo Distributing to ship the load Mr. Santos was carrying. Almo Distributing contracted with Uber Freight to handle (i.e., broker) the logistics of shipping the load. Uber Freight placed the shipment on its virtual “platform” for any of its users to bid on. Velox Transport Solutions, LLC ended up bidding, accepting the shipment, and assigned its driver, Julio Santos, to carry the shipment to Montana.

Velox Transport is a trucking company that hauls freight across the entire United States. As a commercial trucking company, they have a legal duty and responsibility to ensure that they employ safe and qualified drivers. Julio Santos was known to be an unsafe driver. Additionally, during the discovery phase in Mr. Poston’s lawsuit, it was found, shockingly but perhaps unsurprisingly, that Velox did not have an established safety program for its drivers. Worse, after the crash, Velox had no discussions with Santos regarding his reckless and unsafe driving that caused the horrific crash. There was no internal investigation or further training to ensure something as tragic as this crash would never happen again. Velox simply put Mr. Santos back out on the road with no additional training, counseling, or education about safe driving.

Almo Distributing is the largest independent distributor of appliances, consumer electronics, professional A/V equipment, drones, furniture, etc. As a distributor, they have a legal duty and are responsible for ensuring that they select safe freight-delivery companies. Almo has decided to utilize Uber Freight to contract the shipments they have. Despite this, Almo still has a responsibility to ensure that Uber Freight is hiring safe trucking companies to move its freight across the United States.

Uber Freight proudly proclaims on their website that you can book with Uber Freight knowing the carriers can be trusted, and they use all of their extensive resources to securely provide safe carriers to move shipments. However, when Mr. Poston’s Complaint was filed and served on Uber Freight, the company pivoted. Uber claimed it was simply a broker and was not responsible for ensuring the safety of the driver or carriers nor whether they adhered to safety rules and regulations. Simply put, Uber Freight did nothing to vet the drivers or carriers booking through its “platform.” After Mr. Poston’s severe and catastrophic injuries, Uber Freight did not follow-up with Velox to ensure they were employing safe drivers or whether they had made any changes in response to this tragic crash. They did not inquire as to what happened with their driver and did not block Velox or Santos from booking through its “platform” again. Their only concern was to ensure Almo was reimbursed for their payment in a greedy attempt to appease them so that they would continue to book with Uber. Uber Freight filed a motion to be dismissed from the lawsuit (more on this below). However, Federal Judge Donald Molloy of the District of Montana denied their motion, reasoning that Uber Freight was “within the chain of causation” leading up to the crash. Consequently, Uber Freight remained a defendant in the lawsuit.]]></content>

"No one gets to take money from Montana's citizens, particularly when that money is owed for serious corporate wrongdoing, and especially when that money is intended to keep Montanans safe and healthy," Attorney General Tim Fox said. "The $43 million these tobacco companies have wrongfully withheld could have been used to prevent Montanans from developing lung diseases that now make them potentially more susceptible to COVID-19, or insure more of our children earlier and longer. It is unconscionable that more Montanans could live healthier lives if it weren't for the intentional deception of these companies," Fox added.

Twenty-two years ago, Montana and every other state and territory in the country sued the largest tobacco companies for many decades of lethal deception about the health hazards of smoking. Their deception caused the deaths of many Montanans, leaving the state to pay hundreds of millions of dollars in related healthcare costs. As part of the historic settlement agreement, the tobacco companies promised annual payments to Montana and to restrict marketing practices. In exchange, Montana ended its lawsuit.

David Paoli represented the State of Montana in that historic litigation. He and his partners have continued to represent the State of Montana in its fights against these tobacco companies ever since. David and his firm represented Montana in a dispute over funds withheld from one year's payment that lasted from 2006-2012 and in a similar dispute that lasted 2017-2018.

The payments from the tobacco companies fund smoking prevention and cessation programs and other critical health programs. These programs protect the health and safety of children by working to prevent them from becoming "replacement smokers." The agreement ending the lawsuit from Montana and the other states is called the Master Settlement Agreement. Montana uses the annual settlement funds for a variety of public health programs, including the Children's Health Insurance Program, Medicaid, smoking cessation and prevention programs, suicide prevention, children's mental health programs, and communicable disease programs.

For more than a decade, the tobacco companies have broken the settlement agreement and improperly withheld millions of dollars owed to Montana. This year's payment was due on April 15, these tobacco companies, true to form, withheld several million more on April 15, increasing the amount they owe Montana to $48 million.

David Paoli and his partners have worked with four Montana Attorney Generals and their staff to secure better results for Montana than any other state has been able to obtain in disputes with the tobacco companies over the Master Settlement Agreement. <p class="MsoNormal">With the purpose of preventing accidents caused by truck driver fatigue, the Federal Motor Carrier Safety Administration (FMCSA) governs the working hours of anyone operating a commercial motor vehicle in the United States.  The number of hours a truck driver may drive per day as well as the total number of hours the truck driver may work per week are limited by law.</p>

<p class="MsoNormal">When a patient is injured as a result of a Montana doctor's error or medical malpractice, they may be entitled to seek monetary compensation.  However, before a medical malpractice lawsuit can be filed with the court, as a prerequisite, the case must be presented to the Montana Medical Legal Panel.</p>
<p class="MsoNormal">The purpose of the Montana Medical Legal Panel is to:</p>
<p class="MsoNormal" style="margin: 0in 1.0in .0001pt 1.0in;">"prevent, where possible, the filing in court of actions against health care providers and their employees for professional liability in situations where the facts do not permit at least a reasonable inference of malpractice and to make possible the fair and equitable disposition of such claims against health care providers as are or reasonably may be well founded."</p>
<p class="MsoNormal"><i>Montana Code Annotated </i><i>§27-6-102.</i></p>

<p class="MsoNormal">In other words, Montana imposes this additional obstacle for medical malpractice plaintiffs to discourage individuals from filing frivolous injury-related lawsuits.</p>
<p class="MsoNormal">There are specific requirements, pursuant to Montana law, that must be completed in order to submit a case to the Montana Medical Legal Panel.  The first step is to submit an application that conforms to the requirements of Montana Code Annotated §27-6-102.  After the healthcare provider responds to the application a hearing is scheduled before a panel of six members made up of Montana licensed physicians and Montana attorneys.</p>
<p class="MsoNormal">A hearing will then take place where both sides will make statements, witnesses will testify, and medical records and documents may be introduced as evidence.</p>
<p class="MsoNormal">Following the hearing the panel will determine:</p>
<p class="MsoListParagraphCxSpFirst" style="text-indent: -.25in;">1.<span style="font: 7.0pt 'Times New Roman';">      </span>Whether there is "substantial evidence that the acts complained of occurred and that they constitute malpractice," and</p>
<p class="MsoListParagraphCxSpLast" style="text-indent: -.25in;">2.<span style="font: 7.0pt 'Times New Roman';">      </span>Whether there is "a reasonable medical probability that the patient was injured" by the acts complained of.</p>
<p class="MsoNormal">Proving medical malpractice requires that you establish the appropriate medical standard of care and prove the doctor breached this standard of care.  Montana doctors have a duty to possess and exercise the reasonable and ordinary degree of learning, skill, and care possessed and exercised by physicians of good standing in the same area of practice or in similar locality in Montana.</p>
<p class="MsoNormal">Montana medical malpractice lawsuits are complicated.  Most cases will involve extensive and complex medical records and testimony from multiple medical experts and doctors, and consequently will require in-depth legal medical malpractice knowledge and experience.  In addition to the procedural requirements, it is imperative that claims are brought prior to the Montana medical malpractice statute of limitations.</p>

<p class="MsoNormal">The terms "mild," "moderate" and "severe" are commonly used to describe brain injuries and how those injuries affect brain function.  The type and amount of force causing brain injuries are factors that result in one or several areas of the brain being damaged or adversely affected.</p>
<p class="MsoNormal">All brain injuries are complex and unique and require prompt medical attention and an accurate diagnosis and appropriate medical care.  A traumatic brain injury, commonly referred to as TBI, can dramatically affect the victim's quality of life.</p>
<p class="MsoNormal">The most common type of traumatic brain injury is a concussion.  Concussions are often suffered as a result of car accidents or impact sports, but can be caused by any direct blow to the head, whiplash type injuries, shaking or the head, or by an object that penetrates the brain tissue, such as a gunshot wound.</p>

			                <content type="html" xml:base="https://www.paoli-law.com/blog/2019/08/2018-motor-vehicle-crash-statistics-valuable-information-for-2019-2020/"><![CDATA[<p class="MsoNormal">A large number of vehicles travel along Montana's extensive and often challenging roadways every day.  With this comes inherent dangers whether you are a driver or passenger in a motor vehicle.  While it may be easy to assume that you are at little risk of being involved in a crash or that the risk increases in snowy and icy conditions, you may be surprised.  All it takes is a single incident out of your control to cause major or even fatal injuries.</p>
<p class="MsoNormal">The Montana Highway Patrol released its 2018 Annual Report which contains insightful and eye-opening data related to vehicle crashes in Montana.</p>
<p class="MsoNormal">In 2018, there were 23,518 crashes reported in Montana.  Resulting from these crashes were 182 fatalities and 7,036 injuries reported.  In other words, there is an average of one crash every 23 minutes, one injury every 75 minutes, and one fatality every 48 hours.</p>
<p class="MsoNormal">Of the fatal and injury crashes combined, most crashes occurred on dry roads, in clear weather, and during the daylight hours.  In fact, most fatal crashes occurred between 3:00-4:00 p.m. on Thursdays in July.</p>
<p class="MsoNormal">The top three contributing circumstances of all accidents are:</p>
<p class="MsoListParagraphCxSpFirst" style="text-indent: -.25in;">1.<span style="font: 7.0pt 'Times New Roman';">      </span>Inattentive driving;</p>
<p class="MsoListParagraphCxSpMiddle" style="text-indent: -.25in;">2.<span style="font: 7.0pt 'Times New Roman';">      </span>Driving too fast for conditions; and</p>

<p class="MsoNormal" style="text-indent: .5in;">In 2018, three lawsuits against Reflections Academy in Thompson Falls were filed following allegations of sexual abuse and grooming by a male employee, Chaffin Pullan, and professional negligence related, in part, to inadequate therapy and education.  Reflections Academy, a for-profit corporation, is owned by Michele "Mickey" Manning, who also served on the board for Private Alternative Adolescent Residential or Outdoor Program (PAARP).  Until Senate Bill 267 was passed and subsequently became law on July 1, 2019, Montana's residential boarding schools, including Reflections Academy, were overseen by PAARP.  Ironically, PAARP's board was made up of representatives from the boarding school industry it was intended to oversee and regulate.</p>
<p class="MsoNormal" style="text-indent: .5in;">On its website, Reflections Academy advertises itself as "<i>a small, homelike therapeutic boarding school for girls, nestled in the natural beauty of Northwest Montana.  A welcoming haven for struggling teenage girls and their families.  Our unique residential program strives to be a safe haven for struggling teenage girls and their families</i>."  Reflections Academy's website never mentioned employing Cameron Pullan and Chaffin Pullan, twin brothers, well known to Mickey Manning, both personally and professionally.  In fact, Cameron Pullan and Chaffin Pullan were defendants in a prior lawsuit that alleged negligence for the death of a student that occurred at Spring Creek Lodge in Northwest Montana.  Despite being very familiar with the prior litigation and testifying in that litigation, Mickey Manning employed the Pullan brothers at Reflections.  Chaffin Pullan later admitted to having a sexual relationship with a child enrolled at Reflections Academy and allegations of sexual abuse and grooming of other children were made.</p>
<p class="MsoNormal" style="text-indent: .5in;">The <i>Missoulian</i> published a news series about residential treatment programs in Montana following a yearlong review, exposing the dark underbelly of these for-profit youth therapeutic treatment programs. <a href="https://missoulian.com/troubled-kids-troubled-system/collection_d59fcf11-f157-5dd1-8622-0e92810e4ee7.html" target="_blank" rel="noopener noreferrer" data-wpel-link="external">https://missoulian.com/troubled-kids-troubled-system/collection_d59fcf11-f157-5dd1-8622-0e92810e4ee7.html</a></p>
<p class="MsoNormal" style="text-indent: .5in;">On July 1, 2019, the Montana Legislature passed Senate Bill 267, which, in summary, terminated PAARP's licensing duties and transferred those duties to the Department of Public Health and Human Services (DPHHS).  Effective July 1, 2019, DPHHS provides for the licensure and regulation of private alternative adolescent residential or outdoor programs to monitor and maintain a high standard of care and to ensure the health and safety of adolescents and parents using the programs.  DPHHS is also statutorily required now to conduct periodic visits to facilities to ensure that minimum standards are maintained.  For those programs with licenses in existence prior to July 1, 2019, those licenses will be accepted and administered by DPHHS until the licenses expire or are canceled, reduced, modified, or revoked by DPHHS.  With DPHHS overseeing the youth treatment industry, change is underway in Montana.</p>
<p class="MsoNormal" style="text-indent: .5in;">On July 23, 2019, twenty-seven children were evacuated from Ranch for Kids in Rexford, Montana following allegations of "egregious, chronic and persistent child abuse and neglect."  Reportedly, children were hit, kicked, body-slammed, and spit on.  Allegations include a staff member shooting a nail gun at students, prolonged isolation, withholding food, and students being forced to go on 15-20 mile walks in the middle of the night in inappropriate clothing.  It has been alleged that staff inflicted persistent psychological abuse on children and used excessive discipline.  Allegations also include children not receiving critically necessary medical attention and inadequate administration of medications.  It has been reported that staff themselves have indicated that they were unequipped to handle the children accepted to Ranch for Kids.</p>
<p class="MsoNormal" style="text-indent: .5in;">The Ranch for Kids advertises itself as a therapy program serving adopted children with Reactive Attachment Disorder (RAD) and Fetal Alcohol Spectrum Disorder (FASD).  The program has been the subject of several allegations over the 20 years it has been operating.  Ranch for Kids was originally founded by Joyce Sterkel and is now overseen by Executive Director, Bill Sutley, who is Sterkel's son.  Sutley oversees all operations, teaches students, and provides therapy for the children.  Before his work with Ranch for Kids, Sutley was an electrical engineer and does not have an educational degree nor is he a licensed therapist.  Despite this, Sutley holds himself out to be a "teacher" and a "recognized authority on therapeutic process."</p>
<p class="MsoNormal" style="text-indent: .5in;">The DPHHS' July 23, 2019 revocation of Ranch for Kids' license is not the first time its licensure has been revoked.  In 2010 the PAARP board did not renew the ranch's provisional license and despite this, Ranch for Kids continued to operate without a license until PAARP issued a cease-and-desist order in June 2011.  In another lawsuit, after threatening behavior from Sutley and Sutley's refusal to allow an inspection of the premises, the Department of Labor and Industry filed a lawsuit against Ranch for Kids related to long-standing building code issues.</p>
<p class="MsoNormal" style="text-indent: .5in;">While parents often do extensive research prior to enrolling their children in boarding schools, their research may not shed light on the various allegations, complaints, and inadequate staff/owner credentials, which are not always available to the public.  Websites for many therapeutic boarding school programs promise compassionate and quality treatment, experienced staff and therapists, hope, healing, safety for children, and a homelike atmosphere - all in the beautiful Northwest Montana.  For struggling teens and families, these representations seem like a lifeline to healing and promise.  These representations entice parents and guardians to pay upwards of $4,500 a month or more in tuition - in addition to application fees and additional expenses for food, uniforms, therapy, and extracurricular activities.  Unfortunately, despite these enormous rates for tuition and fees, many teens and parents have not benefited from these programs, and in some cases individuals have suffered significant damages as a result of enrolling in and relying on the program.</p>
